House Democrats are finding hope in a bill, introduced in April but recently in news headlines, that would remove the president using the 25th Amendment.
Almost two dozen House Democrats – more than 10 percent of the caucus – have signed on to a bill that could remove President Trump from office using the Constitution’s 25th Amendment.
NBC News reported on the effort on Monday:
House Democrats are on a mission to educate the American people about a little-known power of the 25th Amendment — the ousting of the president.
Led by freshman Rep. Jamie Raskin of Maryland, a group of growing Democratic co-signers has put forth a bill that could force President Donald Trump from office if he were found mentally or physically unfit.
Although it was introduced in April, the bill has gained steam in the past week as Trump’s tweet storms have grown in ferocity.
The bill, sponsored by Raskin, has 21 co-sponsors, including four from true-blue California. Rep. Debbie Wasserman Schultz (D-FL), the disgraced ex-DNC chair, is also a co-sponsor of the bill.
The bill relies on one clause of the first sentence in Section 4 of the 25th Amendment (our emphasis):
Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
The body congressional Democrats want to provide? An “oversight commission” that consists of five Republican-appointed members, five Democrat-appointed members, and a chair appointed “by simple majority vote of the 10 members” listed above.
All 10 appointed members have to be physicians.
After losses in 2016 and 2017, this truly feels like a Hail Mary from Democrats. NTK Network will track how many sign on to the bill.
