Menendez’s Legal Team Aims for Highly Unlikely Mistrial

Sen. Bob Menendez’s (D-NJ) legal team filed a motion for a mistrial on Sunday, claiming U.S. Judge William Walls “abused his discretion by not letting jurors see certain evidence the attorneys say would contradict the prosecution’s contentions.”

“Walls is almost certain to rule against them,” Politico’s John Bresnahan wrote Sunday evening.

Menendez has been charged with accepting free gifts, including private jet flights, from Florida eye doctor Salomon Melgen. In exchange, Melgen received preferential treatment from the senator and his office. Both men serve as defendants in this trial, and both deny any wrongdoing.

The Associated Press has more about the mistrial motion:

In Sunday’s filing, attorneys wrote that they should have been allowed to introduce information, including a document from the official Medicare website, that would have buttressed their contention that Menendez’s meetings with health officials were focused on confusing and inconsistent Medicare reimbursement policies, and not on Melgen’s specific case as the indictment alleges.

They also contend Walls should have allowed testimony from Marc Elias, an attorney who represented Menendez in late 2012 and early 2013 when Menendez was being investigated by a Senate ethics committee over the flights on Melgen’s plane.

If Menendez’s 2012-13 attorney’s name is familiar, that’s because Elias is currently embroiled in the infamous ‘Trump Dossier’ scandal. Elias represented both Hillary Clinton’s campaign and the Democratic National Committee in 2016 when the two groups hired Fusion GPS to investigate President Trump’s Russia connections.

UPDATE: Walls rejected the defense’s motion for a mistrial:

“The defense wants to spend morning, noon and night discussing the contracts in each case, the issue of multiple dosages and the issue of scanning with regard to the security contract with regard to the port in the Dominican Republic,” U.S. District Court Judge William H. Walls said. “It’s a question for this court to determine when enough of enough. It’s not a question that the court interferes with your presentation of the defense. Absolutely not.”

“For the defendants to feel as though their rights have been for the exclusion of a woman whose name I can’t remember right now — it causes me to lose any respect I have for your judgement as far as remaining legal challenges to what I do,” Walls said.
