Bill Nelson’s Latest Lawsuit Asks Judge to Ignore Mail-Ballot Law

The Democrat’s team continues to wage its war against Florida election laws. This time, they want a judge to overrule a law that stated ballots needed to be received by a Nov. 6 deadline.

Sen. Bill Nelson (D-FL) is once again suing the state of Florida over its election laws this week. The Democrat’s high-profile lawyer, Marc Elias, is arguing that ballots received after the Nov. 6 deadline should be counted, despite state law stipulating the ballots needed to be mailed in a timely manner to be counted.

Nelson’s team is arguing that the law should be overruled.

“There is no reason why voters in Miami or Palm Beach or the panhandle or other state in the country shouldn’t have their ballots counted,” Nelson lawyer Marc Elias told reporters in a conference call Monday.

This marks the second lawsuit Nelson’s team has filed with regard to mail-in ballots in the past week. Last week, Elias argued that the Florida law, which states that the signature on mail-in ballots should match the signature on file with the state, should also be thrown out. That law is designed to ensure the person who voted by mail actually cast that specific ballot.

A judge has asked both sides to provide further evidence on the signature lawsuit.

Nelson still trails Gov. Rick Scott (R-FL) in the overall tally by about 12,552 votes. A machine recount is currently underway in the Sunshine State.
