Days after Judge Brett Kavanaugh’s marathon four-day confirmation hearing to be the next Supreme Court justice, at least one swing-vote Democrat is praising the judge for his performance.

Sen. Joe Donnelly (D-IN), a red-state Democrat who was one of three Democrat ‘yes’ votes on then-Judge Neil Gorsuch’s elevation to the Supreme Court, told CBS Indianapolis over the weekend that he is impressed with the judge.

“I think that it has been important that he has emphasized the fact that he would be impartial,” Donnelly said, in response to a question about Donnelly’s impressions of the confirmation hearing. “That’s critical for a Supreme Court justice, is to not be pro-this side, pro-that side, pro-plaintiff, pro-defendant, but to be pro-the Constitution. And to realize how important precedent is, that previous justices have weighed in on these cases. And so, he’s talking about that.”

Donnelly did caution that “we have a ways to go,” but the Indiana senator sure sounds like he’s leaning toward supporting Kavanaugh.

The judge needs at least 50 votes to be confirmed. A few Democratic votes would all but ensure Kavanaugh’s confirmation, given Republicans already hold 51 seats in the U.S. Senate.
