Outside of simple partisan obstructionism, it’s difficult to see the logic behind Democrats’ move.

Senate Minority Leader Chuck Schumer (D-NY) said he would not agree to “a customary year-end package of judicial nominees,” according to a report from The Hill.

Thirty-one judicial nominees await Senate floor action, according to a Republican aide who spoke to The Hill’s Alexander Bolton. But those nominees will not advance in their appointments because Senate Democrats are upset with a ruling that a George W. Bush-appointed judge made regarding the Affordable Care Act, or ObamaCare.

Schumer and his Democratic colleagues are in no mood to agree to a year-end deal after a federal judge in Texas struck down the entire Affordable Care Act last week, including protections for people with pre-existing conditions.

Fringe left-wing group Demand Justice issued a statement through its spokesman, Brian Fallon, who called advancing these judges an “insane” move.

“Especially in light of the Texas judge’s ruling last week ruling ObamaCare unconstitutional, it would be insane to continue to give a free pass to lower-court judges that are ideologically extreme,” he said.

But President Trump did not appoint the judge with whom Fallon, Schumer, and the rest of the Senate Democrats are so upset. Rather, that judge was appointed 11 years ago in 2007 by President George W. Bush.

Neither Fallon nor Schumer seemed interested in connecting the dots between a Texas judge who was not appointed by Trump to the 31 judges that the president did nominate who are awaiting Senate sign-off.

Liberal groups have been furious with Schumer all year for allowing regular order in the Senate, which has resulted in dozens of Trump-appointed judges taking their seats on benches in jurisdictions across the country.

The Senate confirmed 15 Trump-appointed judges in October and 17 others in August. Fallon called the August move “a metaphor for how myopic the Democrats’ approach has been at this dark moment in history.” And in a prescient nod to the ObamaCare ruling last week, Fallon’s August rant included this line:

“An entire branch of government is being lost for generations and Senate Democrats are willfully blind to it. In the coming months and years, these same Democrats will issue outraged statements about the rulings issued by the very judges that they could not be bothered to try to slow down. It is pathetic,” he added.

If Schumer and Senate Democrats continue to bow to the wishes of fringe leftwing groups like Fallon’s, they risk only further politicizing the judicial branch of government.
