President Donald Trump’s outside lawyer, John Dowd, is coming under fire to remarks he made regarding Trump and obstruction of justice claims.

Dowd argued that the president “cannot obstruct justice because he is the chief law enforcement officer.” This is a claim that Liberal Harvard Law professor Alan Dershowitz also expressed in June.

Axios reported on Dowd’s comments:

“John Dowd, President Trump’s outside lawyer, outlined to me a new and highly controversial defense/theory in the Russia probe: A president cannot be guilty of obstruction of justice.”

“The “President cannot obstruct justice because he is the chief law enforcement officer under [the Constitution’s Article II] and has every right to express his view of any case,” Dowd claims.”

In June, Dershowitz’s made similar remarks during an interview on CNN.

“You cannot have obstruction of justice when the president exercises his constitutional authority to pardon, his constitutional authority to fire the director of the FBI, or his constitutional authority to tell the director of the FBI who to prosecute, who not to prosecute. So let’s get out of the weeds and let’s look at the big constitutional question,” Dershowitz told CNN’s Anderson Cooper.
