The senator called Trump's decision to strike Assad's forces "illegal." Were Obama’s strikes on Libya also illegal?

Sen. Tim Kaine (D-VA), following President Trump’s decision to strike Bashar al Assad’s chemical weapons facilities on Friday, criticized the lack of congressional approval, calling the strike “illegal.”

“Trump’s decision to launch airstrikes against Syria without Congress’s approval is illegal,” Kaine tweeted. “What’s going to stop him from bombing Iran or North Korea next?”

In another tweet, Kaine cited old tweets from the president, where he blasted potential action in Syria. “Now President Trump doesn’t think he needs Congress,” he wrote, accusing the president of hypocrisy:

But when President Obama unilaterally launched air strikes in Libya in 2011, the then-senate candidate refused to answer questions about the action’s legality. According to The Daily Progress, “Kaine was noncommittal” at a campaign stop when asked about the Obama administration’s decision to hit the Gaddafi regime:

When asked whether the War Powers Act legally requires the White House to get congressional approval for Libya, Kaine was noncommittal.

“I’m not the lawyer on that,” Kaine said, adding that the president had a “good rationale” for going in, given that sanctions had failed and the United Nations and the Arab League signed off on intervention.

It appears that Kaine’s selective outrage only falls along party lines.
