Leo: Trump Has Never Asked a Potential Supreme Court Nominee About Overturning Roe v. Wade

"I've never talked to him about it. He's never asked me about abortion or Roe v. Wade when the list was being put together," Leo said.

Federalist Society VP Leonard Leo said that President Trump had never discussed his views about Roe v. Wade when Leo was crafting the list of potential Supreme Court nominees and expressed skepticism over people suggesting Trump’s Supreme Court nominee would overturn Roe v. Wade during an interview on Monday.

CNN’s Erin Burnett asked Leo if Trump considers Roe v. Wade to be settled law.

“I’ve never talked to him about it. He’s never asked me about abortion or Roe v. Wade when the list was being put together,” Leo said.

Leo added that when the Federalist Society created the list of 25 possible Supreme Court nominees for Trump, none of the candidates were asked about Roe v. Wade.

“He’s never asked the question of any Supreme Court candidate during the interviews,” Leo said.

Burnett then played a montage of clips from the 2016 presidential election in which Trump promised his Supreme Court nominees would be pro-life and asked Leo whether Trump had changed his mind on the matter.

“I can’t speak to what he said during the campaign. I can tell you what I’ve said before, which is that you know he’s never asked this question of a nominee,” Leo said.

Leo then pointed out that Clarence Thomas is the only Supreme Court Justice, who has explicitly said he would overturn Roe v. Wade.

“There’s a lot of speculation going on here, and I’m just very skeptical about, you know, what people are suggesting might happen,” Leo said.
