The resolution rejecting Trump’s border emergency declaration has already passed the Democrat-controlled House. On Tuesday, it might pass the GOP-controlled Senate.

No More Border Emergency? Congress Set to Reject Trump’s Declaration

The Senate is scheduled to vote on President Trump’s southern border emergency declaration on Tuesday, potentially setting up the president’s first veto.

The House passed a resolution that would terminate Trump’s declaration last week, and Senate Majority Leader Mitch McConnell (R-KY) said he expects it to earn enough support to pass the Senate on Tuesday as well.

That may be as far as the resolution gets, however. Trump is expected to veto the resolution, marking the first time he will use this presidential power, and Congress likely doesn’t have the votes to override the veto, according to McConnell.

That would leave the emergency declaration – an effort to circumvent Congress to get funding for a proposed border wall – in effect, sending it to the courts for a legal battle between the White House and Democrats.

This far, GOP Sens. Susan Collins (R-ME), Lisa Murkowski (R-AK), Thom Tillis (R-NC), and Rand Paul (R-KY) have voiced support for the resolution.

A vote on the House-passed resolution is expected later this week.
