THE CLAIM: “And I did not participate in the chaos around the Kavanaugh confirmations. As [Hawley] knows, I made my decision on Kavanaugh before the allegations surfaced, and it was all about Kavanaugh’s alliance and allegiance to dark money and unlimited political contributions.” – Sen. Claire McCaskill (D-MO) in a U.S. Senate debate on Thursday, October 25

CHECKING THE CLAIM: Sen. Claire McCaskill (D-MO) defended her vote against now-Justice Brett Kavanaugh at Thursday night’s U.S. Senate debate against Attorney General Josh Hawley (R-MO). McCaskill claimed she made her decision on Kavanaugh “before the allegations,” and that her decision “was all about Kavanaugh’s alliance and allegiance to dark money.”

A simple check of the news and of McCaskill’s statement is enough to refute McCaskill’s claim.

McCaskill made her statement opposing Kavanaugh on Wednesday, September 19, in the evening.

The rumors of a letter raising questions about Kavanaugh’s conduct were first made public with an Intercept report by Ryan Grim on Wednesday, September 12, one week before McCaskill released her statement opposing Kavanaugh. Christine Blasey Ford first made her name public in an interview with The Washington Post that the Post published on Sunday, September 16. This was three days before McCaskill released her statement.

In fact, McCaskill’s own statement references the allegations against Kavanaugh:

“I have been thorough in examining Judge Kavanaugh’s record. And while the recent allegations against him are troubling and deserve a thorough and fair examination by the Senate Judiciary Committee, my decision is not based on those allegations but rather on his positions on several key issues, most importantly the avalanche of dark, anonymous money that is crushing our democracy.”

In opposing Kavanaugh, McCaskill did focus on dark money, but also cited Kavanaugh’s views on presidential power and “his position that corporations are people.”

McCaskill claimed on Thursday night that she made her decision on Kavanaugh “before the allegations,” and that her decision “was all about Kavanaugh’s alliance and allegiance to dark money.”

Her decision was not made public before the allegations against Kavanaugh went public. Further, her opposition against Kavanaugh was not “all about” dark money, and a quick check of her statement confirms this.

Therefore, we rate McCaskill’s claim Very Fake News.
