NYT Says It Investigated But Couldn’t Confirm New Yorker’s Kavanaugh Claim

NYT Says It Investigated But Couldn’t Confirm New Yorker’s Kavanaugh Claim

A second woman accused Judge Brett Kavanaugh of sexual impropriety in a New Yorker story published Sunday evening. Deborah Ramirez claims at a “drunken dormitory party” in their freshman year at Yale, Kavanuagh exposed himself to her and forced her to touch his penis.

Kavanuagh strongly denied the allegation in a statement, calling it “a smear, plain and simple.”

If true, the accusation would be very serious. But just as troubling is the fact that the New Yorker published these accusations without any form of verification beyond Ramirez’s word. The publication “did not confirm with other eyewitnesses that Judge Kavanaugh was at the party,” according to the New York Times.

The Times had interviewed several dozen people over the past week in an attempt to corroborate her story, and could find no one with firsthand knowledge. Ms. Ramirez herself contacted former Yale classmates asking if they recalled the incident and told some of them that she could not be certain Mr. Kavanaugh was the one who exposed himself.

It’s somewhat rare for one publication to call out another for failing journalistic standards and practices, particularly when both are liberal standard-bearers. But that speaks to how thin this accusation may be. At the very least, the New Yorker should have insisted on other eyewitness accounts before publishing.

Instead, it published unsubstantiated accusations the same week that senators are expecting to hear testimony from Christine Blasey Ford, the woman who has accused Kavanuagh of forcing himself on her during a high school party in the 1980s.
