A Democrat from Fairfax claimed her bill would do “nothing to change” Virginia’s late-term abortion laws. That’s false.

PolitiFact Blasts Virginia Dem for False Late-Term Abortion Claim

Fact checkers are PolitiFact criticized Virginia Democrat Kathy Tran (D-Fairfax) for a claim she made about her late-term abortion bill. Tran’s bill sparked outrage when Gov. Ralph Northam (D-VA) appeared on a radio show and implied that doctors in Virginia could allow post-birth abortion.

The remark sparked nationwide outrage and prompted Tran to release a video in which she defends her late-term abortion bill. Here’s what she said:

“I want to be very clear about what’s currently allowed in Virginia law,” she said. “Right now, women are able to access an abortion in the later stages of the pregnancy under certain conditions with approval of medical doctors. I’ve done nothing to change that.”

But it’s not true that Tran’s bill would do nothing to change Virginia’s existing abortion laws. On a purely logical level, it would not make sense for Tran to put up a bill that would do nothing to change current law – what purpose would the bill serve?

Here is what her bill would have done:

Virginia allows third-trimester abortions in hospitals if three physicians certify that a continued pregnancy would “likely” kill the woman or “substantially and irremediably” impair her mental or physical health.

Tran’s bill would have lowered the authorization from three physicians to one. That doctor would only have to certify that the pregnancy would damage a woman’s health. The “substantial and irremediable” threshold would have been repealed.

When PolitiFact rated Trans’s claim, they wrote: “The words in her bill make it clear; she did seek to change late-term laws.” They added, “We rate her statement False.”
