The Supreme Court ruled unconstitutional a California law requiring pro-life pregnancy crisis centers to inform pregnant women about abortion.

Pro-life groups scored a huge win at the Supreme Court on Tuesday, when a 5-4 majority ruled a California law unconstitutional. The law required pregnancy crisis centers to inform women of state-funded abortions.

The Court split along ideological lines, with Justices Clarence Thomas, Anthony Kennedy, Neil Gorsuch, Samuel Alito, and Chief Justice John Roberts voting to strike down the California law. Justices Ruth Bader Ginsburg, Stephen Beyer, Sonia Sotomayor, and Elena Kagan dissented.

The Court summarized the law under consideration:

The California Reproductive Freedom, Accountability, Comprehensive Care, and Transparency Act (FACT Act) was enacted to regulate crisis pregnancy centers—pro-life centers that offer pregnancy-related services. The FACT Act requires clinics that primarily serve pregnant women to provide certain notices. Clinics that are licensed must notify women that California provides free or low-cost services, including abortions, and give them a phone number to call.

Clarence Thomas delivered the opinion of the Court, ruling that the law violates the First Amendment of the Constitution.

He wrote that if California is so concerned with advertising its state-funded abortion services, it could better achieve the objective with a public-information campaign, rather than forcing pro-life organizations to advertise practices against their conscience.

“Further, California could inform low-income women about its services ‘without burdening a speaker with unwanted speech,'” he wrote. “Most obviously, it could inform the women itself with a public information campaign.”
