Trump Meets with Donnelly, Manchin, Heitkamp on Supreme Court Vacancy

The three red-state senators voted in favor of Trump’s previous Supreme Court pick, Neil Gorsuch. Will they do it again, months before the midterm elections?

President Donald Trump brought Sens. Joe Donnelly (D-IN), Joe Manchin (D-WV) and Heidi Heitkamp (D-ND) to the White House Thursday to discuss the vacancy on the Supreme Court created by Justice Anthony Kennedy’s resignation announcement.

These three Democrats each voted in favor of Trump’s previous Supreme Court nominee, then-Judge Neil Gorsuch, and the White House no doubt would enjoy another bipartisan vote for Kennedy’s replacement.

Trump has not named a nominee, but he did let reporters know that the name will likely come from a previously published list of 25 candidates. Most on that list are judges in lower circuit courts or state supreme courts. A wild card name on the list is one of the senators’ colleagues, Sen. Mike Lee (R-UT).

Manchin indicated he was keeping an open mind. “I just think you have to go through a process,” he said. “I want qualifications. Somebody that’s well qualified, understands the Constitution and the rule of law.”

Donnelly said he had a “good conversation” with Mr. Trump and “will thoroughly review the record and qualifications” of the nominee. Manchin called his meeting “productive.”

All three Democrats represent states that Trump won handily in the 2016 election and are considered vulnerable in 2018.

No time table has been set by the White House for when a name might be announced. Senate Majority Leader Mitch McConnell (R-KY) said earlier this week that the Senate would vote this fall on a nominee.
