Vulnerable Dems Already Voted to Confirm Possible SCOTUS Nominees

The president interviewed four potential nominees on Monday, and a few of them have already enjoyed Democratic support.

President Trump told the press that he interviewed four potential Supreme Court nominees on Monday as he prepares to name retiring Justice Anthony Kennedy’s replacement next week. Fox News reported that the president interviewed U.S. Circuit Judges Amy Coney Barrett, Brett Kavanaugh, Amul Thapar, and Rayomnd Kethledge.

Ten Democrats running in Trump states this year will have to decide whether they will vote for Trump’s eventual nominee and risk alienating their constituents.

Of the four who Trump interviewed, two received multiple votes from Democrats during their confirmations to the Circuit Court.

Barrett, often mentioned as one of the top choices, was confirmed by the Senate last year. Sens. Joe Donnelly (D-IN) and Joe Manchin (D-WV), both up for re-election in Trump states this year, voted to confirm Barrett to the Circuit Court last year. Sen. Tim Kaine (D-VA), the 2016 Democratic vice presidential nominee, also vote for her confirmation, and Sen. Claire McCaskill (D-MO) did not vote.

And the Senate confirmed Raymond Kethledge to the Circuit Court via voice vote in 2008, meaning no Democrats opposed his nomination. Sens. Sherrod Brown (D-OH), Bob Casey (D-PA), McCaskill, Bill Nelson (D-FL), Debbie Stabenow (D-MI), and Jon Tester (D-MT) were all present for the nomination.

Reports also indicated that the president would meet with potential nominees U.S. Cicuit Court Judges Thomas Hardiman and Joan Larsen.

Both Hardiman and Larsen enjoyed significant support from Democrats during their confirmations. Hardiman’s vote in 2009 saw support from Sens. Brown, Casey, McCaskill, Nelson, Stabenow, and Tester. And Larsen received “yes” votes in 2017 from Sens. Donnelly, Heidi Heitkamp (D-ND), Manchin, Nelson, and Stabenow.

If the president nominates Kethledge, Barrett, Larsen, or Hardiman, many Democrats will have a hard time explaining their opposition to the nominees, given their past support.
